Corruption has been a major obstacle to democracy and development in Indonesia. The Corruption Eradication Commission (KPK) was established to improve this situation, but corruption remains a serious problem. Under its 2015-2019 Strategic Plan, KPK aims to achieve a law enforcement Index against corruption that is 7.5-1.32 points lower than the Index in 2014. As such, this ambitious target will be even more challenging given the fact that corruption today is increasingly complicated and complex, including the increasingly convoluted use of electronic evidence to obscure corruption offenses.<\/p>\n\n\n\n

Although the Indonesian Legal System has recognized electronic evidence since the enactment of the Anti-Corruption Law in 2001, the Kitab Undang-Undang Hukum Acara Pidana (KUHAP) scheme does not provide further guidance for law enforcement officials to effectively use electronic evidence in the fight against crime. Therefore, law enforcement must adapt to a reality where knowledge, skills and capacity to handle electronic evidence has become a necessity.
The Partnership is working with the support of the International Development Law Organization (IDLO) to optimize the use of electronic evidence in the fight against corruption in Indonesia.<\/p>\n\n\n\n

The main objective of the project is to increase the use of electronic evidence in corruption trials. The project strategy focuses on (1) strengthening regulations and procedures on electronic evidence that adopt international standard protocols and guidelines; and (2) strengthening the institutional capacity of law enforcement agencies and the Supreme Court in the utilization of electronic evidence in corruption trials.<\/p>\n\n\n\n

Key Achievements<\/p>\n\n\n\n

The studies completed within the framework of this project have helped improve stakeholders’ understanding and knowledge of the importance of electronic evidence in law enforcement. Stakeholders have also benefited from various types of training on handling and managing electronic evidence organized by KEMITRAAN as part of institutional capacity building.<\/p>\n\n\n\n

Collaboration between KEMITRAAN and LeIP has resulted in the formulation of improved SOPs on the handling and management of electronic evidence. KEMITRAAN is also working with the US DOJ-FBI and KPK’s Anti-Corruption Education Center to facilitate internships for the first batch of KPK’s first responder and digital forensics candidates.<\/p>\n\n\n\n
